Halle Berry Accuses Ex Olivier Martinez of Trying to Turn Son Against Her, Files to Restore Custody Agreement

Halle Berry is taking new legal action against ex-husband Olivier Martinez.

Last week, the 60-year-old French actor obtained a temporary restraining order against the 60-year-old Oscar-winning actress after he accused her of physically abusing their son Maceo, who turned 13 on Monday, October 5.

Olivier alleges that Maceo called him and told him that Halle had allegedly physically attacked him and put him in a chokehold. Read more details in our original post.

In a new filing, Halle is asking the court to restore the 50-50 custody agreement she and Olivier originally established in 2023 as their divorce was finalized, according to court documents obtained by People.

Halle is once again accusing Olivier of refusing to comply with the terms of their custody agreement, reiterating her 2024 claim that he stopped attending sessions with a co-parenting coach that the former couple previously agreed to visit. She seeks to restore their 50-50 custody to regain tie-breaking authority over parental decisions and to compel Olivier back into counseling.

The Catwoman actress is also accusing Olivier of trying to turn Maceo against her, claiming that their son reiterates his father’s side of the former couple’s private conversations and that he often returns from Olivier‘s care “angry and combative.”

Halle claims that despite her hopes that their 2023 co-parenting agreement would “create a change for the better with respect to my and Maceo’s relationship and my relationship with Olivier,” it has in fact “led to more conflict.” She is putting the blame for this outcome on Olivier.

She also outlined several areas of concern with respect to Olivier‘s conduct towards Maceo. First is “unilateral decision making” concerning Maceo’s education, followed by Olivier repeatedly placing their son “in the middle” of their conflicts, and then his alleged “interference” in her “therapeutic work with Maceo.”

Halle says that Olivier is using these tactics as “attempts to align Maceo with him and against me. She also alleged that Olivier makes “attempts to influence Maceo’s teachers and therapist” against her as well.

The actress also claims that Olivier has yet to accept her fiancé Van Hunt as her partner and refuses to include him in family therapy.

“The eighth concern is Olivier’s continued refusal to accept my relationship with Van, who plays an important role in Maceo’s life,” Halle wrote in her filing. “Olivier’s lack of acceptance of Van has resulted in Olivier refusing to permit Maceo to work in a family therapy setting with me and Van as a means to continue to create a healthy environment for our son within the structure of a blended family.”

Olivier has since filed a response and asked the court to deny Halle‘s request entirely. In his filing, the French actor stated that he currently has a temporary restraining order in place against Halle and alleged that there is a risk of “immediate danger” to their son after she allegedly physically abused Maceo. He also claimed that Halle improperly filed an emergency request rather than a regularly calendared request for order.

If you didn’t know, Halle and Olivier were married for two years before splitting in 2015. After a nasty legal battle, the exes finalized their divorce in August 2023 before finally reaching a co-parenting agreement in 2024.

Along with Maceo, Halle is also mom to daughter Nahla, 18, whom she shares with her former partner, model Gabriel Aubry. Just a few weeks ago, Halle spoke about Nahla going off to college.

Halle‘s lawyer released a statement in response to Olivier‘s child abuse accusations.
