Justin Baldoni has scored a major victory in his legal battle against Blake Lively.

The judge allowed three allegations to proceed to a trial, including claims of breach of contract, retaliation and aiding and abetting in retaliation.

Judge Liman ruled that Blake could not bring a sexual harassment claim under federal law because she was an independent contractor, Variety reports. He also ruled that the actress could not file a harassment claim under California law because the filming of the movie took place in New Jersey.

The judge concluded that Blake‘s core retaliation claims against Justin‘s Wayfarer production company and related entities deserved to go to a jury trial.

The case remains on track for a trial to begin next month on May 18. Both Blake and Justin are expected to testify in court.

Back in February, Blake and Justin came face-to-face for the first time since the legal drama began in order to reach an agreement without going to trial. The settlement talk ended up being “unsuccessful.”

Last week, Justin made new accusations against Blake and her legal team.
