Brian Litrell is making headlines after a beach confrontation video surfaced online.

The 51-year-old Backstreet Boys member appears to use a homophobic slur during an argument with a beachgoer in Florida, and the footage is now going viral.

The incident happened on Sunday, March 22 in Walton County, Fla., according to local news outlet WMBB.

In the video, obtained by TMZ, Brian approaches a man identified as Kyle Gallagher while filming him.

The situation escalates with both men arguing and recording each other on their phones. At one point in the clip, Brian appears to say: “You want to be gay? Want to be a f–got?”

“I can’t wait for this to get out,” Brian appears to say in the video.

The video was submitted by Brian himself as evidence after he tried to press battery charges against Kyle, calling 911 and claiming that Kyle committed battery.

Kyle told police he was startled when Brian held a phone inches from his face and reacted instinctively.

“I’ve got him on video; he is sitting on my property. I didn’t say anything to him. I was about this far away, he swipes at me, hits my phone out of my hand, that’s when I called 911, Guys, I don’t want any altercations, I don’t want any beef, I just want to enjoy the beach,” Brian appeared to tell officers in body cam footage per the local news report, seemingly at odds with the submitted video evidence.

Prosecutors ultimately declined to move forward with charges.

Officials said there was a “lack of criminal intent” and noted that the video appeared to support Kyle‘s version of events.

The case has now been closed.

Last year, Brian filed a lawsuit against Walton County, accusing the sheriff’s department of failing to protect his family’s private beach from trespassers.
